In our last episode, we discussed how Affirmative Action, as a term, has been substituted with a three letter acronym DEI, which stands for Diversity, Equity and Inclusion. The apparent neutrality and overall goodness of these terms is but a Trojan Horse. Inside lurks a trap. When these terms are weaponized by social activists, the effect is to create social change through discrimiation. Yes, you heard me correctly. Social activists will discriminate against people on the basis of race, gender, age, heritage, socioeconomic status, choice of sex partners or if you do not experience gender dysmorphia.
Maybe you think that these statements are unjustified?
They are not.
The Supreme Court has determined that Affirmative Action or “Diversity” in the name of undoing the harm of racism by discriminating against people on the basis of their race, or any other protected characteristic, is unconstitutional and therefore unlawful.
Doesn’t matter, Universities, Employers, Governors, Presidents have all carried on this illegal activity.
The Superior Court of Los Angeles determined that setting quotas for seats on the Board of Directors for disadvantaged groups is in violation of the Constitution of the State of California. Doesn’t matter, not one California company protested the law. The lawsuit was brought to the court by a courageous tax payer, Robin Crest.
There are many more cases, but these examples enable us to see the harm that has been done through these schemes to correct perceived social wrongs by breaking the law.
Universities, Employers and Governments, have not abandoned their goals, but instead have made their quota systems more obscure and the schemes more complex. But the intent is the same. It is to discriminate against certain people on the basis of their skin color, race, age, sexual orientation and gender dysmorphia status, in favor of groups deemed to be disad vantaged or under-represented.
However, as the Superior Court of Los Angeles has determined, States cannot make lawful that which is prohibited by increasing complexity.
With the context thusly established, lets have a look at the E in DEI, Equity.
HOW IS Equity defined in this context? Let’s have a look at the University of Michigan’s Equity Statement:
Equity is the guarantee of fair treatment, access, opportunity, and advancement for all students, faculty, and staff, while at the same time striving to identify and eliminate barriers that have prevented the full participation of marginalized groups. The principle of equity acknowledges that there are historically underserved and underrepresented populations and that fairness regarding these unbalanced conditions is needed to assist equality in the provision of effective opportunities to all groups
Hmmm! I suspect that the first part of the statement, “the guarantee of fair treatment, access, opportunity” is really conditional. Its conditional for some groups, and not for others. This is troublesome. Let me offer a couple of perspectives on the above statement.
Elimination of barriers sounds great - who wants bureaucracy and red tape? But forgive me if I don’t think that these are not the barriers the University of Michigan is referring to. They aren’t talking about barriers that all of us face. They want to remove barriers for some people, but not all, and at the expense of some for the benefit of others. Doesn’t sound fair at all.
These barriers could include, for example, lower GPA standards for some, but not others. As we saw in BAKKE, this is illegal. We have also seen universities use lower standardized test scores, for “marginalized” groups, or eliminate them alltogether.
In the context of University Admissions, marginalized groups are determined by subjective criteria, and non-scientific means.
What about Mediocre college essays for some groups? No problem. If you have been identified as being in a marginalized group, you don’t need to worry about your essay.
No extracurricular activities? No problem, you are part of a marginalized group. Go ahead and watch Netflix while playing XBox.
This must be true, because if the University of Michigan was interested in removing barriers for all groups, then they should go ahead and do it. There would be no reason to crow about it.
Equity, as the University of Michigan has defined it above, is immoral and unjust at a minimum.
And likely unlawful and unconstitutional.
This is because benefits are provided only for certain marginalized groups, which are determined by highly subjective criteria.
People who are not placed in these groups are discriminated against due to protected statuses like sex, race, heritage etc.
OK, maybe this is a one off case. Maybe it’s just the people at the University of Michigan that are committing these acts.
Let’s take a look at Twitter, the social media platform company.
You might think that making Twitter’s platform more usable, useful and profitable might be a top concern.
Incorrect, but don’t feel bad.
Advancing Twitter’s social goals of Inclusion, Diversity, Equity and Accessibility are the real objectives of the company.
Lets hear from Twitter itself.
Twitter published a report that is available on their corporate website, called the, “2021 Inclusion, Diversity, Equity and Accessibility Report”.
Oh boy - they’ve added another term - accessibility. I guess that refers to all the handicapped bathrooms and parking spots that are hardly ever used by physically handicapped people. Don’t get me wrong, I like using the handicapped bathroom as much as the next person, but in over 20 years of employment in corporate america, I cannot recall having seen a physically handicapped person use such a toilet. Once.
Usually the handicapped parking spots I’ve seen are used by people who seem to have no physical impediments, but they do have a handicapped parking tag, or they are complete scofflaws.

In the second paragraph, Twitter announces:
“Representation Matters”
But Twitter doesn’t say what “Representation” is and why it matters.
I believe I know what is meant when we say Representative Democracy, but what is a representative business and why should employees care?
Are we all supposed to know?
Please tell us, Twitter, why it matters.
A successful software company should be off creating helpful, useful, profitable software that can be reasonably (and legally) achieved. I am curious to know how representation helps Twitter’s business. Unfortunately this information is lacking. Perhaps it does not exist, or Twitter is withholding it.
Let’s move on.
Further down in the Representation section of the report, Twitter provides a set of graphs displaying the proud results of driving males out of the business (does the term “male” at google include adults who are biologically adult females humans, but feel like a man inside?)
Twitter’s report shows that the company has reduced the percentage of males in Technical Roles from 81.5% in 2017 to 67.1% in 2021.
The percentage of Males in leadership roles has been reduced from 67.5% in 2017 to 59.9% in 2021.
How do these statistics make males feel at Twitter? I doubt that they would state that they feel valued.
Are they perceived as the ‘enemy’ for doing nothing other than being a successful hire, and a good worker?
This is really strange, and if the tables were reversed, and Twitter was proud of reducing Black, Latin or Female employees for example, I would be equally put off.
It’s not right to make anyone feel bad about who they are, even if they are males.
We must remember that males have equal protection under the law. The Paul Kristoffer show suspects that Twitter is running afoul of the law here, and discriminating against males in ways that they are hiding or obfuscating.
For example, they might be eliminating male candidate profiles through screens, before the candidates can ever be considered.
I worked at a company that attempted this approach with me, but it did not work. The Paul Kristoffer Show denounces illegal activity.
Twitter proudly exclaims, “At least half of our global Tweepforce will be Women by 2025. In the US, at least a quarter will be under-represented populations –– specifically Black, Latinx, Native American, Alaskan or Hawaiian/Pacific Islander, or Multiracial.”
Why is “at least half” the right number? Why not 51% or 61% or 100%? There is no logical scientific reason, that’s why.
What are under-represented populations? According to Twitter they are Black, Latinx, Multiracial, and Indigenous populations. “Indigenous” includes Native American, Native Alaskan, and Native Hawaiian/Pacific Islander populations. What is Latinx? It is an offensive term coined in the early 2000’s as a non-gendered form of Latina or Latino.
Twitter does not state how under-represented minority groups are selected. We can only assume the criteria that are used based upon the whims of Twitter employees -
whose most notable characteristic seems to be being good at eroding the market value of their employer.
Religious groups, for example, are not included as an under-represented minority. While skin color, sexual preferences, how one feels inside about gender, are all important groups. This is because Twitter does not really care about people, they simply want to advance their agenda to “improve” society based upon “groups’. But it is individuals who matter.
As the superior court of California has stated, statistics do not proove bias or discrimination. As the Supreme Court of the United States found, institutions may not violate a person’s right to equal treatment in the name of a vague (and erroneous) attempt to correct perceived societal wrongs. Those underrepresented groups may not consist of qualified candidates. To run a business this way is illogical, flawed and illegal. We can assume that Twitter’s recent poor business performance reflects and validates this premise. It is worthy of further study.
Along these lines, It is entirely predictable that Twitter’s share price has been falling, and that (literally) no one wants to own this company. (At the time of this writing, Elon Musk is attempting to terminate his purchase agreement of Twitter). The board of directors at Twitter is fighting to make Elon buy a company that he does not want to buy.
Let’s read further down in the report, where we learn about the Diverse Slates Initiative.
And I’ll warn you, it is especially creepy.
What is the Diverse Slates Initiative?
Well, Twitter policy requires that for all Level 5+ roles, (L5 is a designation for the seniority of a position) at least three finalist candidates must be considered by the interview panel before an offer can be extended.
Of those three, one must be a Woman (global), and at least one must be Black or Latina or Latino (US).
The creepy part is multi-fold:
Firstly:
Who decides the sex and race of the person? Is it Twitter? The interview panel? A birth certificate? Self identification?
Whatever the source, its creepy.
Also, does this mean that adult, biological men, who report that they feel like a woman inside (whatever that means), are considered as women by Twitter? We would like to know. Regardless, this is a bad policy.
Secondly:
If you are selected as a finalist for a position and you happen to be a woman (biologically female (XX Chromosomes) adult human), Black., Latina or Latino, you may infer that you have been selected not because you are the best candidate, but because you fill out a quota based on a trait that you have no control over.
How would that make you feel? It would make most people feel awkward and self conscious. Its de-humanizing.
Conversely, if you are a white male (adult biological male (XY chromosomes) human), you may rightly think that you are properly qualified for the role.
Or, were you selected as a stooge because you were a poor candidate, and you will actually make the selection of a female, black or latin person more likely.
Isn’t all of this nonsense, and should Twitter, and everyone else, simply select the best candidate, and the best terms for the Company? Hiring should be conducted in an objective and fair process.
Conclusion:
The Diverse Slates Initiative creates an unnecessary bureaucracy that slows down business and no longer hires the best candidate.
The Paul Kristoffer show recommendation is to hire the best person, at the best terms for the company.
Be objective in the entire hiring process, so that you do not become subject to unconscious biases. Be brave and truthful about it.
That is all that is required. Instead, Twitter has created this weird system that dehumanizes people and is unnecessarily intrusive.
Twitter’s hiring process infers, or necessitates, that people are being excluded based upon their sex, race or heritage, which is illegal and unconstutional (according to both the Constitution of the State of California and of the United States of America).
Twitter is announcing, publicly, that it is likely committing crimes and violating human rights guaranteed by the Constitution of California, and of The United States.
To make the matter worse, Twitter goes on further to state,
“To help drive leadership accountability in 2021, we announced that our executive team’s annual compensation will be tied to their contributions toward meeting these workforce representation targets”
So executives at Twitter are being paid to discriminate against people on the basis of sex and race, skin color, heritage and the lack of being alphabet people. Does Elon Musk know about this?
I haven’t heard about executives getting paid to discriminate before. This is worse than the KKK, because I think the KKK does what it does for free (I may be wrong, please correct me here). Twitter is a public company, telling the world that they pay to discriminate.
In typical silicon valley tradition, Twitter doubles down by hiring more people globally to enforce descrimination against individuals. The company proudly states that Inclusion & Diversity leads have been hired in EMEA (an acronym that stands for Europe, Middle East and Africa) and LATAM (Latin America). Putting these leads in place further ensures that these bad policies will spread internationally.
Twitter does not explain why they are doing this. They assume that we must all understand the purpose.
But to deny opportunities to people on the basis protected characteristics does not make a better society. It makes our society worse.
An individual does not choose their biological sex, race, heritage or other protected statuses. In this country, a person is not punished for a crime that they did not commit, except at Twitter. The punishment is not being afforded a job opportunity for which you may be the most qualified candidate.
However, no one in power at Twitter cares about the equal protection clause.
