The NSW Supreme Court has blocked a Black Lives Matter protest in Sydney from going ahead next week, opening up the prospect protesters who attend the event could be fined or arrested. On Sunday, the NSW Supreme Court sided with the police, labelling the event a prohibited public assembly. Organisers have indicated to the Guardian Australia they are planning to take part in the event regardless of the NSW Supreme Court’s judgment. The rally was to gather outside of Sydney’s Town Hall on Tuesday and proceed to Parliament House where a petition calling for an investigation into the death of Indigenous man David Dungay Jr, who died in custody in 2015, would be presented. Earlier this month, NSW Police Commissioner Mick Fuller told Sky News his officers would issue fines to protesters breaching health rules. “We will take that matter to the Supreme Court and win, lose or draw we can still take action against people for breaching health orders and if a thousand people turn up maybe I can only write tickets for 500 people but do you want to be the first person to get the $1000 ticket, that’s the question,” he said. Padraic Gibson, who is representing the Dungay Family, said he is planning to lodge an appeal on Sunday afternoon. More than 3,000 people have flagged their interest in attending the event. Organisers said they were prepared to social distance and will use face masks and hand sanitiser.
