Under 28 USC 455(a), a justice is obligated to “disqualify himself in any proceeding in which his impartiality might reasonably be questioned.”

In her 1993 confirmation hearing, Ginsburg steadfastly refused to respond to questions put to her by elected officials about any her views on issues that might come before the court, citing the ethical obligations of a judge to maintain both the fact and the appearance of impartiality.

She specifically responded to a question about sexual orientation by saying: “I cannot say one word on that subject that would not violate what I said had to be my rule about no hints, no forecasts, no previews. 

And yet, now Justice Ginsburg apparently feels that presiding over same-sex ‘weddings’ and speaking openly about how she believes the American people are ready for the Court to recognize a constitutional right allowing same-sex couples to marry.

Justice Ginsburg Must Recuse Herself!

A justice of any level – let alone one of the nine sitting members of the nation’s highest court – must unquestionably remain impartial in regards to any matter before the court.

Justice Ginsburg recognized this fact and invoked it frequently in her own confirmation hearings in 1993.

But recently, her actions – presiding over same-sex ‘weddings’ and speaking out openly about the American people’s supposed readiness to accept a Court decision legalizing same-sex ‘marriage’ show her to be anything but impartial. Legal scholars have called her comments “astoundingly inappropriate” and same-sex advocates like the Human Rights Campaign say Ginsburg has taken “a bold stand for progress and equality.”  They are using her comments to recruit signers to a brief they intend to file in the very marriage case Ginsburg has now signaled her views about, even though the case has not even been presented or argued.

Federal law requires judges to disqualify themselves “in any proceeding in which [her] impartiality might reasonably be questioned.”  In light of these recent and deeply disturbing actions foreshadowing her intended ruling, I am demanding that Justice Ginsburg follow the law and judicial ethics and disqualify herself from hearing the case pending before the court relating to same-sex ‘marriage.’
